If you owe taxes, you must pay by the due date of that year, or penalty and interest will be assessed. If you are expecting a refund, you have 3½ years to file your Minnesota return for the refund. If you expect to owe money but are not ready to file the return, you can avoid any penalty by estimating the amount you owe and paying it either electronically using the e-File Minnesota system or by sending your check with Form M13, Income Tax Extension Payment. You must make a good-faith effort to estimate your tax due and pay at least that amount. If the amount you pay on April 15 is at least 90 percent of your total tax due, it will be presumed that you made a good-faith effort and the late payment penalty will not be imposed. You still will have to pay interest on the amount of tax due that was not paid by April 15, but will not be charged a late payment penalty as long as you file the Minnesota income tax return and pay the balance by October 15. (Note: Be sure to list your extension payment on your Form M1.) Back to questions Where do I send my Minnesota state income tax return? Send your return and all required enclosures to: Minnesota Individual Income Tax St. Paul, MN 55145-0010 This address is also provided at the bottom of your tax return. Your Minnesota Form M1, Individual Income Tax return, must be postmarked by, brought to, or electronically filed with the Department of Revenue no later than April 15 or the due date of that year. We also have a night deposit box in front of our building in St. Paul at 600 N. Robert St., St. Paul, MN Back to questions I moved into Minnesota during the year. Do I need to file a tax return? As a part-year resident, you are required to file if your Minnesota source income (including all income sources received during the time you were in Minnesota) received in 2009 was $9,350 or more. If you had Minnesota tax withheld and your income was below this amount, you would want to file to receive a refund of the withholding even if you don’t meet the filing requirement. You will need Form M1 and Schedule M1NR. Back to questions I lived and worked in Minnesota for only part of the year. Which forms do I need to use? You will need Form M1 and Schedule M1NR. Back to questions If I am moving in two weeks, what address should I put on my tax form so I get my refund? Use the address you want the refund mailed to. Depending on when you file, processing can take up to 90 days for a paper-filed return, and 15 working days for one filed electronically. To ensure you receive your refund, you can use the direct deposit option. Back to questions As I was doing my return I realized I need another form and I live out of state. How can I get one right away? You can download the forms from our website, or we can fax one to you. If you want one by fax, call our help line at 651-296-3781 (Metro) or 1 -800-652-9094 (Greater Minnesota). Back to questions My employer sent me a W-2 or a 1099 form. Do I need to send this with my tax return? No. If you had Minnesota income tax withheld during the year, you must complete Schedule M1W and include it with your return. Do not send copies of your W-2s or 1099s with your tax return. Back to questions What if I already filed and didn't use the M1W? If you already filed your return, but didn't use Schedule M1W (and sent your W-2s or 1099s), your return will still be processed. Do not file another return or an amended return. Your return, however, will need to be processed by hand, and that takes longer. If you already filed your return, didn't use Schedule M1W and didn't send your W-2s or 1099s, the department will contact you to get the information it needs to process your return. Expect a delay in the processing of your return. Back to questions The IRS sent me a letter saying that I am no longer required to file with them. Do I still have to file with Minnesota? We follow the federal filing requirements. If you do not have to file a federal return, you do not have to file a Minnesota return. Back to questions My 16-year-old daughter worked over the summer. Does she have to file a tax return? That is a federal question. Call the IRS at 1-800-829-1040 for assistance. If your daughter is required to file with the IRS, she will also need to file with Minnesota. Back to questions I am working on my M1 form. Line 5 says to include the state income tax refund from line 10 of the federal Form 1040. Line 10 includes a tax refund from a different state. Do I still subtract all of line 10? Yes. You subtract the total of all state tax refunds included on line 10 of Form 1040. Back to Top What is taxable?
If you paid Minnesota vehicle registration tax for a full year, you can deduct the tax over $35 per vehicle. To find the registration tax, go to www.mndriveinfo.org and click on “Tax Info” or look at your vehicle registration renewal form you received from the Driver & Vehicle Services. Back to questions I won some money at a casino. Am I taxed on my winnings? If you are a Minnesota resident, you will be taxed on this income, no matter where it was won. If your winnings were from another state, that state may also tax you. If you are taxed on your winnings by the other state, Minnesota will give you a credit for taxes paid to another state. You will need to fill out the Form M1 and Schedule M1CR. If you are not a Minnesota resident and the winnings were from a casino in Minnesota, you may be required to file a Minnesota return. See information on Filing requirements for individuals. Back to questions I moved out of Minnesota during the year. I worked there all my life. Do I still need to pay Minnesota taxes on my pension? No. Pension income follows residency. Minnesota will tax your pension income only for the portion of the year you were a Minnesota resident. You need to file Form M1 and Schedule M1NR as a part-year resident. Back to Top Paying your taxes
Your quarterly estimated tax payments are due April 15, June 15 and September 15 during the year and January 15 of the following year. If the due date falls on a weekend or holiday, payments electronically made or postmarked the next business day are considered timely. Back to questions I owe money to the state this year, but am unable to pay it all by the filing deadline. What should I do? If you are unable to pay, file your return and pay as much as you can by April 15 to reduce your penalty. The department will send you a bill, at which point you can set up a payment plan. In order to reduce penalty and interest, you can continue to make payments until you receive the bill. Send your payments with the M60 payment voucher to: Minnesota Department of Revenue P.O. Box 64054 St. Paul, MN 55164-0054 When you make your payments, include your Social Security number on your check and state the year and tax type (income tax) for which you are paying. Your check authorizes us to make a one-time electronic fund transfer from your account. You may not receive your canceled check. A 4 percent late payment penalty will be assessed on any tax not paid by April 15. Interest also accrues on the unpaid tax and penalty. Back to questions I owe money this year. Who do I make my check out to? Make your check payable to Minnesota Revenue. You must also complete and enclose the payment voucher, Form M60, with your payment. You can save a stamp by paying your tax electronically, either over the Internet or by phone. For information, click on paying over the Internet using e-File Minnesota, or, to pay by phone, call 1-800-570-3329 and follow the prompts. For each option, you will need your Social Security number and date of birth, your spouse's Social Security number and date of birth (if you are filing a joint return), and your banking information. Back to questions Can I pay my taxes by credit card? Yes, you can pay your taxes by credit card, but the process involves going through a third party that specializes in this type of transaction. For more information, click on paying taxes by credit card. Back to questions I was in a hurry to finish my taxes last night and I put them into the mail without my check. What can I do now? Important. The fastest and easiest way is to pay your taxes electronically using the e-File Minnesota system, either over the Internet or by phone. For information, click on paying over the Internet using e-File Minnesota, or, to pay by phone, call 1-800-570-3329 and follow the prompts. For each option, you will need your Social Security number and date of birth, your spouse's Social Security number and date of birth (if you are filing a joint return), and your banking information. If you won't be paying electronically and want to send a check, you must complete a Form M60 payment voucher and mail it with your check to: Minnesota Department of Revenue P.O. Paper returns can take up to 90 days to process, depending on the date they were mailed. Electronic returns are taking approximately 35 business days to process from the date they were accepted. To check the status of your income tax refund online, see Where’s my refund? You can also call our automated tax service line at 651-296-4444 (Metro) or 1-800-657-3676 (Greater Minnesota). Refund tracking is available 24 hours a day, seven days a week. Please be aware that neither the online system nor the automated refund line will have the status of your return until the return has completed processing and your refund is ready to be issued. If you have not received your refund and:
You don't need to do anything. If you had elected to have your refund deposited directly into your bank account and your account has been closed, the refund will be returned to us. We will automatically issue a paper check and mail it to the address we have on our system. This may delay your refund by about a couple of weeks. I am getting a refund this year, but I will not be able to file by the due date. Will I have to pay a penalty? No. Penalties are assessed as a percentage of the amount you owe. If you receive a refund, you will not have to pay a penalty. You can actually file up to 3½ years after the due date and still receive your refund. I moved after mailing in my forms. Will the post office forward my refund? Yes, they will. To update your address, you can call the taxpayer service line at 651-296-4444 (Metro) or 1-800-657-3676 (Greater Minnesota), or e-mail us your new address, along with the last four digits of your Social Security number (for identification purposes). Send it to indinctax@state.mn.us and we will update your tax records. I filed an amended return. How long does it take to get the refund? Approximately 6 to 10 months. How many years can I go back and file an amended return for a refund? You have 3½ years from the due date of the original tax return to file for a refund. Back to Top American Indians
If you are required to file a federal return, you are required to file a return with Minnesota. If all of your income was earned on the reservation of which you are an enrolled member, you would take a subtraction on Schedule M1M. For further information see American Indians. I lived and worked on a reservation and am eligible for the Federal Earned Income Credit. Will I also get the Minnesota Working Family Credit? You are not eligible for the Minnesota Working Family Credit or the Child and Dependent Care Credit because you had no Minnesota source income. Income earned on a reservation by someone who lives on a reservation is not considered to be Minnesota source income. You may be eligible for the Minnesota Education Credit, since it is not based on Minnesota source income. Back to Top How to get copies of your records
